AGM decision-making: rights, obligations and practice

How do you present a charging facility to non-EV residents? And what are the options if the meeting votes no?

The right to a charging point

Much of the local legislation around charging points in apartment buildings is driven by the European Energy Performance of Buildings Directive (EPBD). In the Netherlands this is being translated into the upcoming Right-to-Charge Regulation (notificatieregeling): residents will soon have the right to install a charging point simply by notifying the board, unless there are technical or safety objections. The regulation is expected in the summer of 2026.

How to present the proposal to non-EV residents

Non-EV residents initially only see costs. Three arguments make the difference:

  1. Lower service charges. The fixed costs of a large grid connection are shared with EV drivers. This often results in a direct saving for non-EV residents.
  2. Increased property value. A parking space with a charging option is worth more - both when selling the space and when selling the apartment.
  3. Future-proofing. From 2035, no new combustion engine vehicles may be sold. Everyone will eventually drive electric. Those who invest now do so on better terms than those who wait until they have no choice.

Preventing a patchwork of private installations

The Right-to-Charge Regulation gives residents the right to install their own point, but a VvE can get ahead of this by offering a collective solution that is better, cheaper and safer. Capture this in a charging policy adopted at the AGM.

Watch out for private installations: Individual charging points cost more per kWh, do not distribute power intelligently, are difficult to connect to the mandatory fire alarm system (BMI) and create conflict if the VvE later builds a professional facility.

A rejection does not have to be the end. Find allies and start building the case.
